1. Who we are
These Terms of Service ("Terms") apply to your use of this website (the "Site") and to your purchases from Gabi, a brand operated by Olem Partners LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, United States ("Gabi", "we", "us"). By using the Site or placing an order, you agree to these Terms and to the policies they mention: our Subscription Policy, Shipping Policy, Refund Policy and Privacy Policy.
2. Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are sold for personal use, not for resale. We sell to customers in the countries available at checkout.
3. Our products
Gabi is a food product: purple yam (ube) powder for drinks and recipes. It's made from a natural root, so its colour, taste and texture can vary a little from batch to batch. Please read the label before use, including the ingredient and allergen information.
Nothing on the Site is medical or nutritional advice. If you have a food allergy or a medical condition, or are pregnant or breastfeeding, ask your doctor before changing your diet.
The seed-paper flower that comes with some orders is a gift, not food: please don't eat it. How well it grows depends on your conditions, so results aren't guaranteed. Because of local plant-import rules, it may be replaced by a seed-free version in some countries.
4. Prices and availability
Prices are set in US dollars and may be shown in your local currency at the exchange rate displayed. We may change our prices at any time; if you subscribe, you'll get notice before any change applies to you, as described in our Subscription Policy. We do our best to show accurate prices and descriptions. If an obvious error slips in, we may cancel the affected order and refund you in full.
5. Orders and payment
Your order is an offer to buy. It is accepted when we ship it. We may refuse or cancel an order (for example in case of suspected fraud, resale or an address we can't deliver to), and we'll refund anything you paid. You confirm that you're authorised to use the payment method you provide. Payments are processed securely by our payment providers; we never see your full card number.
6. Subscriptions
Our products are sold as subscriptions that renew automatically until you cancel. By checking out, you authorise us to charge your payment method at the price, frequency and shipping cost shown at checkout. You can skip, pause or cancel anytime online. Full details are in our Subscription Policy.
7. Shipping, returns and refunds
Delivery is covered by our Shipping Policy. Our 30-day money-back guarantee and how we handle damaged, wrong or lost orders are covered by our Refund Policy.
8. Promotions and gifts
Discounts, gifts and promotions are subject to the conditions shown with them, while stocks last, and can't be exchanged for cash.
9. Reviews and content you share
If you send us a review, a photo or a video, you confirm it's yours and honest, and you allow us to display it on the Site and on our social media and ads, with your first name and last initial, at no cost. We publish every review that follows our guidelines, whether it's positive or negative. We remove content that is offensive, unlawful or unrelated to the product.
10. Our content
The Site, the Gabi name and logo, our texts, photos and videos belong to us or to our licensors. You may not copy or reuse them for commercial purposes without our written permission.
11. Using the Site
Please don't misuse the Site: no fraud, no attempts to break its security, no scraping, and no use that breaks the law.
12. Other websites
The Site may link to other websites and use third-party services (for example payments and shipping). We're not responsible for their content or their policies.
13. Disclaimer and limitation of liability
To the extent permitted by law, the Site is provided "as is", and our total liability for any claim relating to an order is limited to the amount you paid for that order. We're not liable for indirect or unforeseeable losses.
Nothing in these Terms limits or excludes liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Consumers in the United Kingdom and the European Union keep all their statutory rights, and consumers in Australia keep the guarantees of the Australian Consumer Law that cannot be excluded.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, United States. If you are a consumer living outside the United States, you also benefit from the mandatory consumer protections of the place where you live, and you may bring a claim in your local courts.
15. Changes
We may update these Terms from time to time. The version that applies to an order is the one published on the day you place it. The date at the top shows the latest update.
